Acceptance of Terms

National City Asphalt Paving is an asphalt paving contractor based in National City, California. We provide residential and commercial asphalt paving, sealcoating, striping, repair, resurfacing, and related services. Services are performed at customer properties within our service area.

The Site provides information about our services and allows customers to submit estimate requests. Submitting a request through the Site does not create a contract or guarantee that services will be performed. A contract for services is only formed when both parties have agreed to a written proposal or service agreement.

Estimates and Pricing

All estimates provided by National City Asphalt Paving are based on information available at the time of the site visit or customer inquiry. Estimates are not binding until confirmed in a written proposal signed by both parties.

Estimates may change if conditions at the property differ materially from what was observed during the assessment, if the scope of work is modified by the customer, or if unforeseen site conditions are discovered during the job. We will notify you of any material change to pricing before proceeding with additional work.

Scheduling and Cancellation

Scheduled work dates are subject to change due to weather conditions, equipment availability, or other circumstances outside our control. We will make reasonable efforts to notify you as soon as possible if a scheduled date needs to change.

If you need to cancel or reschedule, please contact us as early as possible. Cancellations made after materials have been ordered or crews have been dispatched may be subject to costs incurred on your behalf, as outlined in your service agreement.

Asphalt and sealcoating work requires dry weather and appropriate temperatures. We reserve the right to reschedule jobs if conditions are unsuitable for quality work.

Payment Terms

Payment terms are stated in the written service agreement for each project. Unless otherwise agreed in writing, payment is due upon completion of the work or as specified in the proposal.

Failure to pay within the agreed timeframe may result in interest charges, suspension of future services, and referral to a collections process. For larger commercial projects, a deposit may be required before work begins, as specified in the service agreement.

We accept payment methods as outlined in your service agreement. Check your proposal for accepted payment types.

Customer Responsibilities

By requesting services from us, you agree to:

• Provide accurate information about the property and the scope of work needed
• Ensure the work area is accessible on the scheduled date, free of vehicles and obstructions
• Inform us of any underground utilities, irrigation lines, or other buried infrastructure before work begins
• Keep people and animals off newly completed surfaces for the time specified by our crew
• Notify us promptly if you believe any work was not completed as agreed

Warranty and Disclaimer

Where a written warranty is provided as part of a service agreement, it covers the specific work performed under that agreement and is subject to the terms stated therein. Warranties do not cover damage caused by customer misuse, acts of nature, changes to subsurface conditions after completion, or failure to follow post-installation care instructions.

The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the accuracy or completeness of information on the Site.

Natural variations in color, texture, and surface finish are inherent in asphalt and sealcoating materials and do not constitute defects.

Limitation of Liability

To the fullest extent permitted by applicable law, National City Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the services we provide. Our total liability for any claim arising out of a specific project shall not exceed the amount paid for that project.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.

Intellectual Property

All content on the Site, including text, images, graphics, and design, is the property of National City Asphalt Paving or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use Site content for commercial purposes without our written permission.

Dispute Resolution

If a dispute arises between you and National City Asphalt Paving related to the Site or services performed, we encourage you to contact us first at team@nationalcityasphaltpaving.com or (858) 599-0449 so we can work toward a resolution directly.

If we cannot resolve the dispute informally, the parties agree to submit to binding arbitration in National City, California under the rules of a mutually agreed arbitration organization, unless otherwise required by law. This does not prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in a court of competent jurisdiction in San Diego County, California.

Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Changes take effect when posted on the Site with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
